Five years following the tragic Grenfell Tower fire, the Building Safety Act was enacted in 2022, introducing stricter safety regulations for buildings considered high-risk. This legislation aims to empower residents with enhanced rights and safeguards, contributing to the safety of their living environments. The investigation into the Grenfell Tower disaster identified the building’s defective cladding as a key factor in the rapid spread of the fire. In response, cladding on buildings throughout the UK is now under scrutiny, with a procedure known as cladding remediation being implemented to remove and replace cladding where it poses a risk.
What is cladding remediation ?
Cladding remediation involves the process of removing and substituting parts, or in extreme scenarios, the entire cladding system of a building that is considered hazardous, particularly in terms of fire safety. According to information from the Department for Levelling Up, Housing, and Communities, around 500 buildings across England have been identified for cladding remediation. As of October 2022, data reveals that 95% of these identified structures have initiated or completed the necessary work to eliminate and replace the dangerous cladding.
Which types of cladding materials require remediation?
The urgency for cladding remediation applies to the kind of cladding found at Grenfell Tower – namely, Aluminium Composite Material (ACM), which consists of polyethylene plastic encased between two aluminium sheets.
Furthermore, various other cladding materials not made of ACM have been recognized as hazardous in fire situations and thus require remediation, including High Pressure Laminate (HPL) panels, various Insulation materials including : expanded polystyrene EPS boards, etc. To align with updated safety standards, it is necessary to strip high-rise residential structures of dangerous ACM and non-ACM cladding and substitute them with materials that are less likely to contribute to fire spread due to their limited combustibility.
Who bears the responsibility?
Under the Building Safety Act, leaseholders are shielded from any expenses tied to the rectification of hazardous cladding systems. Both building owners and landlords will have to cover the costs associated with their property’s repairs.
To address the issue of unsafe ACM cladding on both social and private residential buildings taller than 18 meters, the government has pledged a complete funding package through its £600m ACM Cladding Remediation Fund.
Additionally, the £5.1bn Building Safety Fund (BSF) is designated for financing the removal and substitution of unsafe non-ACM cladding systems on residential structures exceeding 18 meters in height, across both private and social housing sectors. This fund ensures that leaseholders in England’s residential buildings are insulated from the financial burden of eliminating unsafe cladding remediation works.
In the realm of building design, construction, and finalization, the statutory duty holders — including the client, principal designer, and principal contractor — are tasked with managing safety hazards and compliance with the new building regulations.
The Developer Pledge
On January 10, 2022, the Department for Levelling Up, Housing and Communities’ Secretary of State presented a strategy to fundamentally reform building safety standards in England. The initiative places a strong emphasis on protecting Leaseholders and holds accountable those responsible for construction flaws, ensuring they cover the costs.
Fifty-two developers have pledged their commitment to the government’s initiative, promising to carry out essential fire safety improvements on buildings taller than 11 meters. This commitment applies to structures they have developed or refurbished within the past 30 years, aiming to shield Leaseholders from bearing these expenses.
